The Supreme Court recently upheld an Arizona law that requires employers to make sure they only hire workers who are in the US legally. The US Chamber of Commerce and the ACLU objected to the law partly because they worry holding employers responsible for who they hire would increase discrimination.
I don’t claim to know a lot about Canadian immigration law but it is my understanding that Canadian employers are also required to validate employees are in the country legally. Illegal immigration in Canada is minimal.
If the US is serious about limiting iillegal immigration, we need to address the reason foreign workers come to the US illegally – jobs. Making employers responsible for their hiring decisions is a step in the right direction.
